TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of www.morfinthelifecoach.com and the coaching services provided by Cesar Morfin Barajas, doing business as Morfin The Life Coach ("we," "our," or "us"). By using the Site or booking any service, you agree to these Terms.

1. SERVICES OFFERED

We offer coaching services for personal development. Specifically:

- Discovery Call (15 minutes, free)
- First Session (60 minutes, $100 USD — optional introductory session)
- Individual Session (60 minutes, $250 USD each — standalone, no program required)
- The Morfin Method (3-month program, available in 1, 2, or 3 monthly payment options: $1,800 / $1,900 / $2,100)
- Next Level (monthly subscription, $250/month, post-Morfin Method only)

Sessions are conducted in-person in Phoenix, Arizona, or via video conferencing (Google Meet). Sessions are bilingual (English / Spanish).

2. NOT CLINICAL THERAPY · IMPORTANT DISCLAIMER

Coaching is NOT a substitute for psychotherapy, psychiatry, medical care, or any clinical mental health treatment. Cesar Morfin Barajas is a Certified Life Coach, not a licensed psychologist, psychiatrist, therapist, social worker, or medical professional.

If you are experiencing a mental health crisis, suicidal ideation, severe depression, severe anxiety, active trauma, or any psychiatric or medical condition, please contact a licensed professional, dial 988 (US Suicide & Crisis Lifeline), or go to your nearest emergency room.

If during the coaching process Cesar identifies clinical signs that require clinical care, he will inform you and refer you to an appropriate licensed professional.

3. ELIGIBILITY

You must be at least 18 years old to book services for yourself. Teens ages 14–17 may receive coaching ONLY with written parental or legal guardian consent and presence at intake.

4. BOOKING & PAYMENT

- All payments are processed via Wix Payments in USD.
- First Session: $100 USD payable at booking. Non-refundable per Refund Policy.
- Individual Session: $250 USD payable at booking. Non-refundable per Refund Policy.
- Morfin Method: full payment or installment schedule chosen at checkout. Each installment processed automatically per the chosen plan.
- Next Level: monthly recurring billing until cancelled.
- Receipts emailed automatically.
- If a payment fails, your access to services may be suspended until resolved.

5. CANCELLATION & RESCHEDULING

- Minimum 24 hours notice required to cancel or reschedule a session without penalty.
- Cancellations or no-shows with less than 24 hours notice count as a consumed session.
- Full refund/cancellation terms in our Refund Policy.

6. CONFIDENTIALITY

Everything shared in coaching is held in strict confidence as described in our Privacy Policy. Materials, exercises, and recordings provided to you are for your personal use only and may not be redistributed.

7. CLIENT RESPONSIBILITIES

You agree to:

- Provide accurate, truthful information
- Inform us of any health condition relevant to coaching
- Show up for booked sessions on time
- Pay all fees promptly
- NOT share, redistribute, or sell any program materials, recordings, or methods
- Treat Cesar with respect and professionalism

We reserve the right to refuse or terminate service if these responsibilities are not met.

8. INTELLECTUAL PROPERTY

The Morfin Method, all written materials, frameworks, exercises, and proprietary content are the intellectual property of Cesar Morfin Barajas. They are licensed to you for personal use only. Any reproduction, redistribution, or commercial use without written permission is prohibited.

The Site content (text, images, design) is also our intellectual property unless otherwise indicated.

9. NO GUARANTEES OF RESULTS

Coaching outcomes depend on your engagement, openness, honesty, and effort. We do not guarantee specific results. Personal transformation is non-linear and varies by individual.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Morfin The Life Coach and Cesar Morfin Barajas shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the services. Total liability for any claim shall not exceed the amount you paid for the specific service in the 12 months preceding the claim.

This limitation does not apply to gross negligence, willful misconduct, or violations of law.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Morfin The Life Coach and Cesar Morfin Barajas from any claims, damages, or expenses arising from your breach of these Terms.

12. DISPUTE RESOLUTION

Before any formal dispute, both parties agree to attempt good-faith resolution via direct communication.

If unresolved, disputes shall be resolved by binding arbitration in Phoenix, Arizona, under the rules of the American Arbitration Association. You waive the right to participate in class actions.

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules.

13. CHANGES TO TERMS

We may update these Terms. Continued use of the Site or services after changes constitutes acceptance. Material changes will be communicated to active clients via email.
